Legal Question in Family Law in Washington
16yo Divorces, Is she entiteled to half of Vacation Package?
My daughter was married at age 16 and is now getting divorced 10 months later. While she was married her husband bought them a membership to a vacation club, the Worldmark Club. He spent $12,000 to get 10,000 credits of vacaton time a year. He bought it with money he got in a lawsuit and now has in a trust fund so no one can touch his money, including my daughter. But the vacation package is in both their names. Is she entitled to get half of it? Someone said because she is under 18 she can't have it. Were they married long enough? Or is it his cause he paid for it? Please write me back if anyone knows about this type of case, thanks.

Who is handling the divorce? You should retain local counsel to insure it is handled properly. The general rule is money owned before marriage is separate property. Property purchased with it remains separate property unless the parties take an action to make it community property. Adding your daughter's name may have made it community property. The issue is if this action was enough. It is a factual questions. Her age is not an issue as she is or was an emmancipated minor and is treated as an adult. The length of the marriage would be a factor only in interpreting the intent of the parties. Visit my web site if you need more information on the general rules but you should retain local counsel.
