what happens after an appeal?

I am in a custody dispute over my 4 year old daugther. I left her dad and brought her with me because he was being unfaithful and not acting like a family man anymore. He served me with legal papers 4 months later wanting to obtain full custody of our daughter. We had the first hearing on April 22, and he appealed the decision and we had the second hearing on May 15. He wasn't able to take my daughter away, but I switced attorneys hoping to appeal the decsion as he got away with a lot. My new attorney told me i wasn't able to appeal anymore and that i had to start all over if i wanted to change the visitation times for him and for me to have good reasons/documentations as to why my daughter should spend less time with her dad. If i'm not able to appeal the decision anymore and can't use any of the past information, can i consult/hire an attorney he had already consulted with but not hired? Is there still a conflict of interest eventhough it would be like starting a new case?
