Legal Question in Family Law in Washington

assumption of mortgage post-divorce

My ex-husband was awarded the house and took responsibility for the mortgage in our divorce settlement. However, my name is still on the mortgage and I signed a quit claim deed giving him the property. The mortgage is assumable, and I am willing to pay the fees to have him assume it without me. He is resisting this. What kind of leverage do I have in this situation? Thank you.

Re: assumption of mortgage post-divorce

What does your decree say about when he has to get your name off the mortgage? The decree is controlling on that. If there is no date set then you can still file a motion to amend the decree, and then to force compliance, but you are going to have to convince the court as to what is reasonable.
