Legal Question in Family Law in Washington

Bigomy?

My husband and I got married in Nevada after we were told by his lawyer that the divorce was finalized. We now reside in Washington and just found out that his former wife had not completed the final paperwork for the divorce. Does this void my current marriage?

Re: Bigomy?

This is more of a Nevada law question than a Washington question. The key thing to determine is: When was the Nevada divorce final? If the Nevada divorce was final before your Washington marriage ceremmony then your Washington marriage is valid. If the Nevada divorce was not final before the Washington marriage, your Washington marriage is not valid (and is therefore bigamous).

Well, it certainly sounds as though you have an issue. Probably best to do what's necessary to ensure that his previous relationship is ended formally.

You will want to go back to the attorney who told him he was divorced and ask him to fix the problem. If he doesn't you can certainly ask who his errors and omissions carrier is. Do this in writing.

Hope this helps. Powell
