Legal Question in Family Law in Washington
My brothers well being
My father allowed my brother to go with his mother as appointed by court. Within 3 days the mothers sister informed my father that she was in a motel and drunk with my brother there. He immediately went and picked him up. Now he is in contempt for not allowing her to keep him for the entire week. He has no proof other than the sister that the mother was ever intoxicated. The sister refuses to make such a statement. How can my father use this in court to ensure the safety of his son?

Re: My brothers well being
The reality of this situation is that your father wil have to try and convince the sister to testify or he wil have to try and find another witness to corroborate his story about the drunken mother and her behavior in the motel. Without the witness, your father will be involved in a "he said - she said" situation which is very difficult to prevail on in a court of law. Maybe a maid from the motel could testify as to the condition of the room or perhaps another person, e.g., the housekeeping manager or someone from hotel management. This is a very difficult situation at best.
