Legal Question in Family Law in Washington

Name Change After Divorce

Hi-My husband divorced his second wife in 1997. We recently found out she is still using his last name, and has had children that are not his, but who are using that name. Do we have any legal recourse to bar her from using his surname since they are no longer married, and the children she has are not his?

Re: Name Change After Divorce

When your husband divorced her, there was an opportunity for her to change her name. If that didn't happen, then it appears she intended and wanted to keep her name. As it is her name, no, you don't have "legal recourse" to make her change her name.

Think about it. If somebody announced that you had to change your name, what would your response be?

Hope this clarifies. Elizabeth Powell
