Legal Question in Family Law in Washington
Changing my childs name
I have a son who was born while his mother was still married to someone else. My son's last name is the same last name of the person, my ex was married too. She is no longer married to this individual and my son is 10 years of age. He wants his name changed to my last name but I can't do it unless the mother agrees. She doesn't know what to do or how to do it. How do I go about getting his name changed when he was born in Washington state. Is there another way of getting his name changed other than going to washington.

Re: Changing my childs name
It appears that you are residing in another state, if the child is Washington, the mother can start a parentage action to name you as the father and change the child's name, or you can establish parentage by affidavit, the forms are available from the Department of Vital Statistics. You should be aware, however that once the child is declared as yours, you'll likely be responsible for paying child support. While now her ex-husband is the presumed father and he is responsible for paying support.

Your fact description is confusing. You should go back an rewrite it, especially keeping person and identities clear.
