Legal Question in Family Law in Washington

Changing Jurisdiction

I moved home to Washington from CA a year ago. My Ex decided to remain in CA. The divorce and custody was decided in CA. How do I change jurisdiction to WA? Is this common or easy? If I want to ammend support/visitation do I need to go to CA?

Thank you.

Re: Changing Jurisdiction

You have left out some relevant information: Are the children residing in Washington? If the children are in Washington with you then one year is more than enough time to do a modification. You may register the California Decree at anytime for enforcement purposes (but you have to have six months residence with the children to do a modification). The registration and notification requirements are precise under the Uniform Child Custody Jurisdiction Act as enacted by Washington State. I have done two contested/resisted UCCJA cases (and been successful in both). Note that although the registration of all the documents may be effected under the UCCJA and enforcement of support is available under the Uniform Interstate Family Support Act, the conditions for modification of the child support obligation are different, more stringent as covered by the UIFSA.
