so i have a girl friend that has been in an abusive situation and she cannot live with her dad for that reason and he is in jail. she has been living with some foster parents by court order and now her mom wants her back, but she does not want to go at all!!! her mom cannot suport them and it is not a good enviorment at all to live with her. she is 16 does she have the right to stay with her foster parnents ? can she choose? can she take it to court and win?

She needs to explain all this to the caseworker and guardian ad litem (or CASA). She may be able to have a dependency guardianship (RCW 13.34.230 and following, http://apps.leg.wa.gov/RCW/default.aspx?cite=13.34.230) or a third-party custody (chapter 26.10 RCW, http://apps.leg.wa.gov/RCW/default.aspx?cite=26.10).

If she is self-supporting, she may be able to go for emancipation. See chapter 13.64 RCW, http://apps.leg.wa.gov/RCW/default.aspx?cite=13.64.
