I was divorced in 2006, the court gave my daughter primary custody because I didn't have a job and was living with my parents. He is a drug addict and is neglecting our daughter. I need to apply for custody. I have been working at a job for over a year now after completing school. Spent all settlement money on divorce.

What a mess. You have to be able to say that the non moving party's circumstances (not yours) have changed such that the current arrangement is no longer in the child's best interest.
You need a lawyer. This just isn't something you can do yourself.
