Legal Question in Family Law in Washington

child custody

the father of my child just went to jail for 30days. We are in the middle of a custody battle and we're at the point of needing to set a trial date. Is there anything I can do faster to get full custody of my son considering he is sitting in jail?

Re: child custody

Unless the father is in jail for assaulting the child or child abuse, chances are if you did not attempt to take advantage of the situation the court would have more respect for you.

A "custody battle" can only happen between two equally fit parents. Sounds as though it may not be a contest, if he has criminal charges - if you don't.

Your primary residential placement questions can be resolved by agreement or by trial. Those are your options. Hope this helps. Elizabeth Powell
