Child custody

Is it possible for me to fight for custody of my brothers child? He is not being taken care of properly, can I even win? I live in Arizona, the child lives in Spokane WA.

Yes. The test is two-part: Either (1) the parent(s) is/are unfit, or (2) continued placement of the child with an otherwise fit parent would have a detrimental effect upon the development of the child.
