Child Custody Question

Hi- I need advice on what I'm suppose to do...I'm the mother of an almost 2 year old boy and his dad has been absent almost all of his life. He moved out of state with in days on his birth and was arrested for drug possesion charges 2 times. I have tried to help his dad to have a relationship but when given oppurtunities he continued to do drugs and the last straw was when it happened around my son. His dad is know threating that he will get custody and my son will have to spend huge amounts of time in California... I want to know if it's posssible to have his rights removed since he has neglected his son and has never paid child support. I know that i'm doing what is in the best interst of my son and I want to be proactive and make sure that he is protected. Thank you for your help!

You probably can't have the parent-child relationship terminated,but you could petition to have a residential schedule entered that identifies reasons for restrictions and provides for restrictions on residential time with the father.

Over the years, I have handled many of cases like yours and have been quite successful at severely limiting if not completely keeping the bad parent at bay. There are quite a few tools at our disposal through the Courts, but it heavily dependent on the facts and each of the parties history. What county are you in?
