Legal Question in Family Law in Washington
child support
I was divorced in washington and now my children live in west virgina, and I live in florida. I currently pay 1300 a month for my 3 kids. My wife is trying to enroll in welfare in west virgina and tells me that they will be wanting me to pay child support thru the state of west virgina. Is this possible since our divorve and child support was in washington. Ive also had another child who currently lives with me in florida, does this reduce my current obligation for my child support payments if my income is still the same as when my divorce was final.

Re: child support
A child support order can be inforced in any state. As for the amount, a child from a second relationship does not in itself reduce current obligations. In Florida, you may be able to have the judgment modified if your financial situation has changed substantially but you would have to prove that to the court.
Re: child support
You were divorced in WA, so there is a WA support order. You do not say how long your ex and kids have been in WV; if it has been more than six months, then this action is now properly in WV.
Are you paying on a WA support order? Can you prove your payments?
That is going to help you with the state of WV.
But I'm only licensed in WA. Hope this helps - Elizabeth Powell
