child support

My husband has custody of his 2 children, the absent parent being the mother is on social security and has been for the past year, she has never paid her child support except for tax returns that are taken from her for back support but is not and never has paid current support, being that she is on social security can child support still be collected?

Arguably, yes.

You can go through the division of child support - they are on line at DSHS under access dot wa dot gov.

Or, you can get a court order or enforce an existing order.

You don't say what support is set at, and there is a statute that limits the amount of support to a percentage of an obligor's take home - in other words, if you have an order that provides she'll pay $400 per month, but she only has $600 per month, the transfer payment could be reduced.

But not back support. AND the support accrues interest at 12% per annum until paid in full.

If you don't have an administrative order or a court order, you need to contact the Family Support unit of your local prosecuting attorney's office or private counsel.
