Child support and income

My son's mother is behind $10,000 in child support. She has either missed child support payments or does not pay the full amount of support every month. She now has a 7 month old baby and she claimes she can only work 20 hours a week. How can I verify that she is voluntarily UNDER-employed? Also, she and her new boyfriend owns a $300,000 home and she either owns a volkswagon jetta or makes payments on it. How can I find out if she's hiding income? I don't know how she can afford all this other stuff, yet she can't even afford $192 in child support each month? What can I do?

It would appear that you have an order that provides for direct payment of suport. You can file a motion for contempt on the child support. If you have a direct payment order, you will need to scrupulously document what payments you have received. If you have support collected through the registry you should have documentation from them. This would get the back support reduced to a judgment amount and some attorney's fees if you have attorney represent you on this. As to how to verify her current income, the first place to look is your order of support. You can file for an adjustment anytime you think there may be a significant change in circumstance. In the adjustment the parties have to submit financial source documents and a financial declaration unless they do it by agreement.
