Legal Question in Family Law in Washington

Child Support

I was just married. My husband pays child support as ordered in the state of Washington. His ex is now threatening to take us back to court now we are married and I have a job to get child support from my income. Is she able to do this?

Re: Child Support

In WA, the income of a new spouse is not used as a basis to modify child support upwards. She may be able to modify on other grounds such as that its been more than 24 months, or a child has turned 12 since the last order, but merely re-marriage is not grounds for modification.

Hope that helps. Elizabeth Powell
