Child support - 2nd marriage

I'm getting married. My new spouse has 2 kids from a previous relationship. Will my income be used to calculate child support for his two kids? I woudl like to know what I can do to protect my income from being used as support.

Re: Child support - 2nd marriage

Congratulations on your upcoming marriage. The child support modification statute does not allow the judge to use the income of a new spouse as a basis to modify child support for an obligor, or to count your income as your new husband's income.

If his ex starts a child support modification action, you would benefit from a consult with a local family law attorney.

Hope this helps. Elizabeth Powell
