Legal Question in Family Law in Washington

child support for non biological child

pending paternity testing, if my 7 yr old turns out not to be his, would he still have to pay child support, because of an emotional bond? How would this change the parenting plan we have right now?

Re: child support for non biological child

Depends on whether you are married to him or not and other factors.

Petitions to disestablish paternity have to be filed before the statute of limitations runs, and that depends on whether he's the presumed father or not.

So it isn't really about the emotional bond, no. There are sound policy reasons for that statute of limitations, not the least of which is not destroying a child's world.

I hope there is more to this fact pattern, because the facts you sketch suggest a little child is about to have their heart broken.

I hope you have counsel helping you.
