Legal Question in Family Law in Washington

Child Support & Re-Marriage

My fiance has 60% of his check taken for child support, after we get married, will they be able to take more because of combined income? She lives in NY and we live in WA.

Re: Child Support & Re-Marriage

You don't say where the support order was entered. The state in which the order was entered determines what law applies to determining child support. I know that under Washington law, your income could not be used to calculate his child support obligation, but it can be used to determine whole family need issues. I can't address the application of the law of other states.

I concur with Mr. Steuart. If this is a WA order, they cannot use your income to determine your husband's for child support purposes.
