Legal Question in Family Law in Washington

child support/custody battle

My ex boyfriend is seeking child support and with work being slow, I cannot afford it, what can I do? Also, how long does it take to get custody? Right now he has our daughter, and we spoke with a family court person for an ''interview'', but this has been going on since Spet. of 2007!

Re: child support/custody battle

It is unclear if paternity has been established, but assuming it is not at issue, I am surprised that child support was not established earlier. You should look at the Child Support Workheet Instructions to determine what the child support amount will be. The time required to effect a residential schedule varies by county, but you should expect it to take several months. You may want to consider moving for temporary orders. You should be aware that in terms of establishing who will be the residential parent, that all things being equal the party with who has been the primary caregiver and with whom the child has resided will be more likely to continue to be the primary residential parent.
