Legal Question in Family Law in Washington

child visitation

A friend of mine is trying to get visitation with his baby. The mom is making up lies about him to make him sound abusive and that he's not good with children. He can easily dispute that with all his nieces/nephews but how does he prepare to deflect all her lies, what can he do to get visitation and custody of his daughter. She's 9 months old and he has never seen her, every time he went to her house to see his daughter she just called the police on him. He lives in Oregon and the baby lives in Washington

Re: child visitation

He should file an action to adjudicate parentage (if he isn't on the birth certificate) or to enter a parenting plan and an order of child support.

Using the DV argument when it isn't warranted is gross, and makes judges deeply unhappy.

He should be very careful not to provoke a situation where she could claim DV.

But if there is no parenting plan, and he's the other parent, he has as much right to see the baby as she does.

Hope this helps. Elizabeth Powell
