My child's provider went on vacation and I had a family friend watch my child for me. DSHS was very clear to me about the fact that the person would not get paid until thge background check came back. She watched my child for a total of 10 days and the background check did not go through until July 26, 2007 and she started watching on July 9th. I have already givin up $150. out of pocket and I didn't really have that money to give up. She stated to me that she and I had a verbal agreement and I told her that DSHS is going to be paying her. what do I do? I have already filed a fair hearing but haven't gotten back any more information.

Seems to me that you are obliged to pay her in the absence of a written agreement in which she promises to only get paid by DSHS.

You have a duty to follow DSHS rules when they pay bills on your behalf, so I can't tell whether they are going to pay for this or not.

If they were very clear that the person would not get paid UNTIL the background check came back remember that is different from if they were clear that the person would not get paid UNLESS the background check came back.

Two different words, and in DSHS - speak, it matters. Hope it helps with your administrative hearing.
