Children's Phone Visitation Rights
My former spouse remarried another soldier. They are overseas with my children. Her spouse will not let me talk to my children if he is at home. They will move back to Washington state in June 98. There is no provision for phone visitation in my divorce decree, but there is every other provision one can think of, visitation on holidays, kids are with me in the summer etc. My son and daughter tell me her husband is the one who keeps them from answering the phone. If this problem persists, is their something I can do when they move to Washington. I mean can I take her spouse to court and have a court order made against him? If the court orders him to cooperate his commander has no choice but to order him to cooperate also.

I suggest that you contact the company commanderor the legal branch of the service for assistance.A court can order telephone contact especiallygiven the present distance.A company commander couldbe the easiest solution. If you are still inthe military, I suggest you seek the judge advocateoffice for assistance.

If you are still in military visit the JAG office. If not they still may be helpful since your spouse is in the military. Contact a base chaplin and have them contact the commanding officer of you ex. If all else fails you can get the court to modify it to permit telephone contact. However this will cost money. Your spouse may be violating the existing order by deliberitly interferring with you your contact but that would depend upon the working in the existing order. You did not state where or what court granted the order.
