Legal Question in Family Law in Washington

Claiming Child on Income Tax

My ex and I alternate years we claim our son for Income Tax. Our son lives with me continually throughout the year with maybe a visitation once or twice a year. I stopped support enforcement through DCS, and he no longer pays child support. How do I get the exemption changed so he no longer claims him. He provides no financial support or medical. My husband and I pay for everything.

Re: Claiming Child on Income Tax

You would have to file a motion to modify or adjust child support. If he agrees, you can get it changed easily and get a new support order entered that reflects the new plan for allocation of exemptions. You should both be aware that the new support order will show a support amount, and the obligation accrues if not paid even if it is not enforced, i.e it could be enforced later as a back support obligation.
