Legal Question in Family Law in Washington
Clarification for extraordinary expenses
I really need to know exactly what the below section means. We pay $450 a month for coverage for the kids and the mother does not have coverage, or at least she never uses it. Then she sends co-payments and anything not covered by insurance to our house to pay. What exactly is our responsibility?
The order reads:
The cost of such coverage for the mother does not exceed $82.5 (25 percent of mothers basic child support obligation on Worksheet line 7), and the cost of such coverage for the father does not exceed $301.25 (25 percent of fathers basic child support obligation on Worksheet Line 7).
The Obligor shall pay 66% of extraordinary health care expenses (the obligors proportional share of income from the Child Support Schedule Worksheet, line 6), if monthly medical expenses exceed $61.00 (5% of the basic support obligated from Worksheet line 5).''

Re: Clarification for extraordinary expenses
It means that your insurance covers the ordinary expenses.
Extraordinary expenses are the expenses that she incurs in excess of $61.00 in a month and that are not insured. So theoretically, she has to come up with $61.00 before asking you to pay more.
OTOH, if she spends $61.00 then you are on the hook for the next $301.25.
So until the uninsured medical expenses get to $362.25 in one month, your order spells out who pays what.
If your child is going through more than $362.25 in extraordinary medical care in one month, take him/her to another doctor for a second opinion.
This can happen with braces easily. They are generally extraordinary care because they are not medically necessary.
