Legal Question in Family Law in Washington

Is there a common law separation?

My husband has not lived in my house for 5.5 years. He was removed from the home by the court system due to a domestic violence incident. A friend told me that after 7 years of living apart you are considered to be legally separated. Is this true for WA state? How would the assets be divided? Thank you -

Re: Is there a common law separation?

No, it is not true. The marriage may be defunct for the purpose of responsibility for each other's post-separation debts. But there is no common-law divorce in WA. You'll need to file for divorce if you want to be divorced.
