Legal Question in Family Law in Washington
This is probably a very common question you are asked. I am married (soon to be divorced), and I came home from work one night to find my wife and child and all of their belongings missing. They moved from WA to OK where her family resides, entirely without my permission. I want to know if this is legal, what my recourses are, and if there is any way I can get HER to come back here with the child (I own a business and cannot just "leave the state" on a whim but my daughter means everything to me). And for your reference, no there was never a single instance of abuse in the marriage, and no I do not have drug or alcohol problems or engage in illegal activities. Don't know if that helps. I'm really desperate here and can't seem to find this information online, it's all about when you are 'divorced' what the laws are, not when you are still married.

Assuming it has been less than six months since your spouse moved out, you should file for divorce and a motion for temporary orders (to get a parenting plan and order of support into place) immediately (be sure to set the hearing far enough out that a process server in OK has time to get her served).
