cps, children taken from mother go to father out of state

My boyfriend's ex-wife has started using drugs and is now being investigated by child protective services. She currently lives in the state of Washington while we live in Arizona. My boyfriend however, did not go through all of the legal steps for custody before we moved, as he did not see the need since his ex did not have any problems with visitation. Now that she is on drugs she will not let him have custody while she cleans up. If they are taken away from her by CPS will the state send them to live with their father, even though he is out of state?

The mother's drug problems will probably benefit your boyfriend for custody purposes if he has no problems that would hinder his caring for the children.

I'd have to know what the nature of the custody relationship is. Was a case filed? Has paternity been established? Is there a parenting plan? In addition, has he contacted the CPS? Does he have the CPS records?

I'd want to know what county the children are in and who the caseworker is.
