CPS - When is it harassment?

My son is a known story teller, but he started a new school and they failed to read his record from the previous school. So when he told his teacher I hit my 2 year old in the face with a belt, I had CPS at my door that night. Now, the 20 yr old case worker says she has to keep the case open for 90 day it has so been over 6 months. Every month she calls to schedule her last monthly so she can close the case. When can I contact a lawyer and make this stop, they have even said themselves the story has no merit. Can you help me??
