cps investigation

my boyfriend of 4 years has been divorced that long. The parenting plan states that the mother have primary custody of all 3 girls (the oldest is not his). In 2006 she signed parental rights of the oldest to me after an altercation. The other 2 kids began to live with grama (we didn't know then). In 2007 the middle child began living with us due to inability to control her and we then tried to get the youngest and dad ended up losing his job due to too many court dates. We have now found out (in june) that the youngest has been removed from her mothers care (she was there only a month) due to a cps investigation which said she was in relapse and unable to care for her daughter. Before we even knew what was happening they had placed the youngest with her aunt. dad now feels like she should of been automatically placed with him but CPS is making him see the child only under supervision and has not even considered our home (where her sisters live) as a placement. Dad was asked to do a UA and passed 1st time. The next shelter care is not until 1 week after school starts which seems cruel and now we found out they gave her a kitten. It feels out of control and advise is needed to preserve her mental health and dad relationship????

The course here for getting a judicial review is to file for a modification of the parenting plan and a motion for temporary orders (you'll also want to notice CPS on the motion for temporary orders). Do your homework, don't just file a motion without plenty of supporting evidence. You (your husband) should seriously consider retaining counsel to assist you with this.
