CPS removed my nephew from parents home

My nephew was removed from the custody of his parents by the larimer county police dept and then placed into the custody of Child protective services. After undergoing the proper steps the Family safety and resource team presented and had approved by the courts a safety plan for the child. The child was placed into the guardianship of my sister, with supervised visits allowed 3x a week until both parents underwent mental evaluation and treatment. If the mother of the child was to bring a birth certificate and the police to the childs daycare could she legally take him? She has not underwent any of the steps agreed upon in the safety plan. They are currently in WA state, no longer in CO. All this took place about 3 weeks ago.

This sounds like the child is in CO and the CPS case is in CO. I think that CO law is controlling. Where the parents are is not as significant as where the child is. You probably want to resend this question as CO law (and you might want to work on making the statement more coherent).
