custody issues

who has custody in a non wed split? we have been taking turns having him fairly but she is talking about hurting herself so i want to keep him till the judge decides otherwise, can i do that?

Procedurally, where is this case? Is paternity determined. Do you have a court order, usually a parenting plan or residential schedule? If you do, you have to follow that until you get another order, you can generally get an order in ex parte (pending a hearing) if you can articulate a legitimate fear for the safety of the child.
