Hello,

I was wondering if you could answer a child custody question for me. I have a girlfriend who has a child with a man with whom she is not married to, but they live together. She is ending the relationship with him and will be going to court to work out custody.

Would there be a problem in the custody dispute if she, and her child, moved in with me? In addition, can she move away from the city that the father lives in as long as the visitation requirements are met?

There is no problem with moving in with you from the woman's standpoint. However, if you would be supporting her, and the child, you could end up owing support fo rthe child under certain circumstances. Also, her moving to another city at thi spoint may be all right, but there will be, or may be, complications with that move relating to visitation and residential time that the biological father has with that child. These situations are very complicated and you would be well advised to investigate all of the facts and circumstances that surround this change of residence of this single mom. Do you intend on marrying her? If so, that will complicate things more down the road.
