Third-party custody is very difficult and for good reason; you have to prove that neither parent is fit and that you are a better custodian of the child than either parent.

You don't state where this child's parents are in the picture. Where is her mother? Is the child with her mother? Unless the mother is not fit, and the father is similarly not fit, you are not going to prevail.
