Legal Question in Family Law in Washington

daughters moms

last year my daughter had to go to four different schools because her mother decided to keep moving her around and she is only in the second grade. i had finally convinced the mother to let me have her for the rest of the school year. during the summer months the mom got mad because the state was taking child support from her and she didnt want my daugther to return to school with me for that reason. i live in a different city than her anyways she missed about 2 months of school this year before her mom calls and tell me she cant handle her anymore. she missed lots of school when with her mother and now when she goes and visits her she tells my daughter that she can move back if she keeps behaving, anyways i dont want to send her back with her mom due to this reason and numerous others that i cant really type out at this time. but my question was does the mother have the right to get my daughter back whenever she wants and what can i do about that if she can. we dont have any parenting plan whatsoever and i am really trying to get custody of my daughter. any insight to this would be helpful. thank you

Do you have a court ordered parenting plan or residential schedule? If you don't, you need to file a petition to establish one. Until a parenting plan or residential schedule is in place you have no effective mechanism to make anything happen.
