Deposition

I have been told that I will be served to be deposed regarding the divorce of a friend. I have questions regarding my legal rights. Can they compel me to show up? Can I not answer personal questions if I choose? Can I answer some questions but not all or is it all or nothing? Can I leave at any time?

They can compel you to show up. You should have an attorney with you if you have any questions about what you should or should not answer. Generally in depositions inquiry is permitted into anything "reasonably calculated to lead to the discovery of admissible evidence" and so it can be a fairly wide-ranging examination.

No, having been properly subpoenaed you cannot leave when you want, and you can be recalled until the attorney conducting the deposition decides he's done asking questions.

Your friends' attorney is not necessarily your attorney. If you don't have an attorney consider hiring one to prep you and accompany you to this dep.

Practice tips: understand the question you are being asked and only answer that question.

DON'T VOLUNTEER information. Don't get gabby. If you do not know the answer say that. If you only "heard" it from someone else you cannot know whether it's true or not. (Whatever it is).

Tell the truth, no matter how painful.

Don't talk too fast it makes the reporter crazy. This is an examination not a conversation. Don't get in a hurry.
