A notice of absence or unavailability alerts the court and the clerk of the court and the opposing counsel that an attorney will not be available during a certain time period to appear or answer pleadings or otherwise respond to another attorney or party's request for a motion hearing, or other actions requiring the response, such as a deposition.
If an attorney receives a notice of absence and deliberately schedules a hearing or other matter requiring the absent attorney's attention, the absent attorney can use the notice of absence, upon his or her return to his office, to request sanctions against the party that ignored it.
