Dissolution of Marrige

When I was 15 years old I got married that was 17 years ago. I have not had contact with him for most of the 17 years, he is now remarried without a divorce from me, what should I do?

His second marriage is not valid, theoretically. Your marriage from 17 years ago - was there a license or certificate? How did you get it if you were only fifteen?

Your options are to do nothing, or to get a copy of your marriage certificate (it is on file either with the state or the county where you were married) and consider whether you should be taking further legal action or not.

It would be a summons and petition for dissolution.

Needless to say, this could suprise Wife number two and any children.

Your marriage may not have been valid (as Ms Powell pointed out when she touched on your age and questioned how you got married). In which case you may still want to take legal action, but it may be to seek a declaration of invalidity (often called an annulment). You should probably consult with an attorney because to get an annulment you have to meet one or more of the specific criteria, e.g. lack of capacity (age or mental defect), wrong sex, fraud, already married, etc. There is also a concept called defunct marriage, but you should only consider that after discussion with an attorney. To protect yourself you want to get a judicial determination on your marriage.
