Division of assets when not married

How can I get my share of assets from my ex-fiance (we were never married)? When I caught her cheating, she concocted some allegations and managed to get an order for protection and therefore got sole possession of the home we bought together and ALL of my property. After 4 court dates over 4 months (and an ass chewing from the Judge) the court ordered her to give me my ''personal essential property''. And that is as far as that particular judge's jurisdiction reaches (personal essential property).

However, she still has possession of everything we ever acquired in the 5 years we were together - most of which I purchased. The order for protection expires in 14 days, but I don't know if I should just go there and take my property.

What type of suit do I need to file, and with what court, in order to force her to divide assets?

You need to file a civil action in superior court to distribute property. it would look much like a dissolution of marriage. The matter you are addressing in the case you have appeared for 4 court hearings is the protection order case, and the court in that case does not have authority to make a distribution of property. As to the cheating, it is legally irrelevant.
