Legal Question in Family Law in Washington

Division of property after split up

My ex and I lived together for 17 years. We have lived apart now for 6 years and I have recently married. We bought a house and land a few years before we split up. He still lives there. Both our names are on the bank loan and title. I would like to dissolve this, with my share of this property, or have him move out. I do not know if I should attempt to get half his retirement at the time of the split up or not. We used my retirement on the payments after I lost my job. (the Split up followed this). I would appreciate any advice you may have. Thank you

Re: Division of property after split up

You don't say whether you were married to your ex or not. If you were not married, then you probably don't have any claim against his retirement, but you might be able to recoup what you put into the property.

It depends on many factors and this area of the law is in real flux right now.

You could bring a quiet title action against the real property and possibly a partition action to get him to sell so you can have your share of the value, whatever that is.

Call or email if you need a referral to an attorney in Eastern WA who can help you with this.
