Is a divorce necessary

My boyfriend got married to a woman in 2005, she was still married from a previous marriage and never divorced even to this day, is my boyfriends marriage to her valid? Would a divorce be necessary or would this be grounds for an annullment if the marriage is valid?

Your BF's marriage to W is not valid, based on what you stated here.

However, it exists. Therefore the remedy is a petition for a finding of invalidity.

The forms are available on line at www courts dot wa dot gov under the dissolution section.

Your BF needs to be able to prove what he alleges. Not as part of the petition, but as part of the final decree of invalidity. You may do well to talk with an attorney who can assist you with this.
