Legal Question in Family Law in Washington

Divorce with Children in the military

My husband is in the military. We are living in Washington and have been here two months. We just moved from overseas and are considering divorce. Our state of residence is California. We have children. Where is the appropriate place to file. Can I file in California. They told us we cannot file here in WA until the kids have lived here for 6 months.

Re: Divorce with Children in the military

You could file in Washington (as military), and I think you could file in California (as residents), and either court could have jurisdiction. There may be some advantages (legal and logistical) to filing in one state versus the other. Without more information I could not address the legal advantages, the logistical advantages are fairly obvious (using local courts in Washington). The 6 month rule relating to jurisdiction over children is generally correct, but there are exceptions that your situation would fall into, that would allow Washington courts to have jurisdiction.
