Where to get my divorce

My daughter is in the military in the state of Washington.She was married in South Carolina. Her husband has been in federal prison for eight months and has about a year to serve.He promises to make the divorce a battle. Is there any place she can go to obtain a divorce without his consent?

A convicted felon is not in a very good position to contest a divorce. Your daughter should go to the nearest court.

On the way, she should stop off at the office of an experienced matrimonial attorney and get some practical advice on the issues of grounds, child custody, and equitable distribution.

While her husband may only be earning 18 cents / hr. making license plates, courts usually regard incarceration as a self-inflicted economic injury. He would have to pay child support based on his ability to earn, based on his previous [pre-incarceration] track record.
