How does a divorced spouse gain legal access to VA disability award numerics of the other spouse? He claims he is 100% disabled, an impossibility, plus he draws full retirement benefits.

Divorce is an action governed by the state, not the VA.

Disability pension is one portion of a pension, generally there is another part (the majority) which is not coming from the disability.

This information is available in a dissolution so that the spouse can accurately calculate their portion of the retirement and other pension amounts.

If you are in Pierce County, contact Bruce Baxter or Jim Cathcart. Both are really good at military dissolution issues.

His 100% disability status does not mean that the entire pension he draws is unavailable to you as part of your property settlement.

You just need counsel to know how to ask the right questions to get the answers you need.
