Legal Question in Family Law in Washington

Divorce or not divorce

My elderly father is living with me now and has moved out of his house that he once shared with his wife. He wants to give her his retirement and sign over the house to her but not get a divorce. If he signs the home or any other property over to her and takes his name off of everything, is he still liable for those things because they are still married? I advised him to at the very least file a seperation, is there any other info. I can tell him to protect himself.

Thanks, Chris

Re: Divorce or not divorce

A legal separation would be advantageous to your father in terms of making a clear line on what is community property & liabilities v. separate. It would mean that in any future liability that the creditor would not have a claim for anything after the date of separation.
