Legal Question in Family Law in Washington

Divorce

I live in Vancouver WA. My father has willed me his property in OR. He is dying of cancer. If I divorce after he dies does my husband have any claim?

Re: Divorce

Assuming your father makes it clear in his will that it is going to you, and not to you and your husband it will be your separate property. That said, when a divorce is before the Washington Courts all property is subject to distribution and how it gets distributed is controlled by several factors, but the court will attempt in the process of making a fair and equitable distribution to distribute separate property to the person who has that interest, age of the parties, debt and income, the amount, character and value of property is considered in making all distributions.
