Re: divorce/custody
From your statement, I am unable to tell what your sought resolution of this matter is, or what your purpose is in moving to Idaho. I am going to assume that you are still married and that no petition for dissolution or separation has been filed, that your husband lives in Washington. Based on you statement and my assumptions, you can move to Idaho anytime you want to, and take the children. You should be aware that for six months after you move, your husband can file for separation or divorce in Washington and force the parenting plan and child support issues to be resolved here, and that if you were to file for divorce in Idaho within the first six months there that the Idaho courts could not address parenting plan or child support issues except under emergency conditions. There are other facts which that would cause my opinion to change. My office is about 7-15 minutes from 98106. I do provide 30 minute free consults.
