Legal Question in Family Law in Washington

divorce/foreclosure

Wife and kids moved out after she took most money from account which was agreed upon to be used for home improvement. She file legal seperation.I was under the impression we were going to seek counseling and her and our girls would move back. Apparently that is not what she wants. I was told that mortgage was up to date. The household finances is something unfortunately she took care of.She requested that i only see my girls 4 hours a day supervised. There is no reason for it. i tried it and was disappointed to say the least when the person that was to supervise and who had driven them was clearly under the influence of something, i later found out it was some sort of pills because my daughter found them. My wife allows me to go over there once in a while it seems though we end up arguing and it I know its just good for the girls. Consequently I dont get to be with them as much as Id like. My wife is accusing me of things that simply arent true. I think shes dillusional. I found out shes been taking mail from my box so I was unaware that nothing at all had been paid and shed lied about mortgage being up to date. Im now facing foreclosure and have no income at this time. I dont know what to do

Re: divorce/foreclosure

It is unclear where this case is procedurally. If there was a temporary parenting plan entered, that can be modified. If there was a parenting plan entered there should have been a hearing or one scheduled. The hearing would be your opportunity to present evidence about residential time with the children. The property issues are too complex to address in a short answer without more information, but the general rule is that parties are not allowed to take actions relating to property that will result in the wasting of that property. You should consult with a local family law attorney.

Mr. Steuart is right. If you cannot fund a retainer, contact the Snohomish County Bar and see if they have a clinic where you can meet an attorney and get some advice tailored for your situation.

Sorry I can't be more help. You need your own lawyer. You need to get a job and a new bank account as soon as you can.
