Divorcing when one partner is in another country

Greetings!

My marriage was solemnised as per Hindu Rights in India. I currently reside in WA and hold a legal work permit . My spouse is in India.and never visited USA. I want to apply for divorce in the state of Washington. Is this possible ?

Yes, you can get divorced in Washington. You will need to effect service on your spouse in India. The Washington courts won't have jurisdiction over property, debt, children, child support, (unless it is something that was created or is currently in Washington state). Essentially what you get is a decree that says you are divorced, but does say much about anything else. Whether and how to get the decree recognized in India is another matter, and beyond the scope of my knowledge. You will probably have to address any of the other issues in India subject to the law there.
